INTEREST INSURED
To indemnify the Insured up to the Limit of Indemnity against all sums which the Insured shall become legally liable to pay as a result of any claim or claims first made against the Insured during the period of insurance and reported to the company during that period for breach of professional duty arising out of any negligence whether by way of act, error or omission on the part of the insured, in the conduct of the Insured’s profession or business as specified.
In addition to pay the costs and expenses incurred with the written consent of the Company in the defence or settlement of any such claim or for any claim covered by any of the extensions for which limits are stated in the schedule, provided that if a payment in excess of the amount of indemnity available under this Policy has to be made by the insured to dispose of a claim, the Company’s liability for such costs and expenses incurred with its consent shall be such proportion thereof as the amount of indemnity available under the policy bears to the amount paid to dispose of the claim.
SPECIAL NOTATIONS
This policy is written on a claims made basis and subject to its terms, limitations, and exclusions responds to claims first made against the Insured and reported during the policy period and/or events of which the Insured becomes aware during the policy period which could give rise to a future claim provided that the insured notifies the insurers during the policy period of the circumstances of such events.
